Overview

These Terms of Service ("Terms") govern your use of the PairIQ mobile application ("App"), operated by PairIQ LLC, a Florida limited liability company ("PairIQ," "we," "our," or "us"). By downloading, installing, or using PairIQ, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1 Acceptance of Terms

By accessing or using PairIQ, you confirm that you are at least 13 years of age (or 16 years of age if you are located in the European Economic Area), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2 Description of Service

PairIQ is a nutritional pairing intelligence application that provides information about how foods interact at a nutrient absorption level. The App allows users to:

Receive supplement timing guidance based on meal content

PairIQ is provided on a freemium basis. Core features are available free of charge. Premium features are available through a paid subscription as described in Section 7.

Automated scoring. PairIQ's absorption scores, grades, and suggestions are produced automatically by software applying published nutritional research to the foods you enter. No human reviews your meals. These outputs are general information, not individualized advice, and no legal or similarly significant decision is made about you by the App.

3 Health and Medical Disclaimer

This is the most important section of these Terms. Please read it carefully.

PairIQ provides general nutritional information for educational purposes only. PairIQ is not a medical application and is not intended to replace professional medical advice.

Not medical advice. The content provided by PairIQ, including food pairing scores, absorption estimates, supplement timing suggestions, and nutritional insights, is for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment.

Not a substitute for professional care. Always seek the advice of a qualified physician, registered dietitian, or other qualified healthcare provider with any questions you may have regarding your diet, health condition, nutritional needs, or supplement use. Never disregard professional medical advice or delay seeking it because of information you received from PairIQ.

Not a medical device. PairIQ is not approved or cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device or diagnostic tool.

Supplement interactions. The supplement timing information provided by PairIQ is based on general nutritional science and is not personalized medical guidance. Individual responses to supplements vary. Consult your healthcare provider before starting, stopping, or changing any supplement regimen.

Nutritional science limitations. Nutritional science is an evolving field. The information in PairIQ reflects current peer-reviewed research but may not account for individual variation, emerging research, or specific health conditions.

Populations requiring extra care. If you are pregnant or breastfeeding, under 18, managing a diagnosed medical condition, taking prescription medication, or have a history of disordered eating, consult a qualified healthcare provider before acting on any information in the App.

Not for emergencies. PairIQ is not designed for and must not be used in a medical emergency. If you believe you are experiencing a medical emergency, call your local emergency number immediately.

By using PairIQ, you acknowledge and agree that PairIQ is not responsible for any health outcomes, adverse effects, or decisions made based on information provided by the App.

4 User Responsibilities

You agree to:

5 Intellectual Property

All content within PairIQ, including but not limited to the nutritional database, pairing algorithms, scoring systems, design, graphics, text, and code, is the property of PairIQ LLC and is protected by applicable intellectual property laws. Third-party data incorporated into the App remains subject to its own licence, as described in our Privacy Policy.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. This license does not include the right to:

Create derivative works based on the App's content or functionality

Copyright complaints. If you believe content in the App infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to info@pairiqapp.com. We will respond to properly submitted notices.

6 User Data

All personal data generated through your use of PairIQ — including meal history, saved meals, preferences, and supplement information — is stored locally on your device. You retain full ownership and control of this data at all times.

PairIQ collects anonymous usage analytics through PostHog to improve the app experience. This data is not linked to you as an individual. See our Privacy Policy for full details.

PairIQ does not claim any ownership rights over data you create within the App. You may delete your locally stored data at any time through Profile → Data & Privacy.

7 Subscriptions and Payments

PairIQ offers a premium subscription ("PairIQ Pro") that unlocks additional features including expanded meal builder capacity, unlimited Discover meals, unlimited barcode scans, full history access, the AI Weekly Coach, and the daily supplement plan.

Pricing: PairIQ Pro is offered as an annual subscription at $29.99 per year (equivalent to approximately $2.50 per month), or as a monthly subscription at $4.99 per month. All prices are in U.S. dollars and are billed through your Apple App Store account. Prices in other regions are set by Apple's regional pricing and may differ.

Free trial: PairIQ Pro includes a 7-day free trial for new subscribers. No charge is made during the trial period. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the price listed above and your Apple ID will be charged.

Automatic renewal: Subscriptions renew automatically at the end of each billing period — annually for the annual plan, monthly for the monthly plan — unless cancelled at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.

Managing and cancelling: You may manage or cancel your subscription at any time in your Apple ID account settings under Subscriptions. Cancellation takes effect at the end of the current billing period, and you retain Pro access until then. Deleting the App does not cancel your subscription.

Refunds: Refunds are handled by Apple and are subject to Apple's App Store refund policy. PairIQ does not process refunds directly and cannot issue them on Apple's behalf.

Price changes: We may modify subscription pricing. Where required, Apple will notify you of a price increase and obtain your consent before charging the new price; otherwise your subscription will not renew at the higher price. Any price change applies only to future billing periods.

Restore purchases: You may restore a previously purchased subscription through the Restore option in the App's paywall screen.

8 Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and PairIQ LLC only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9 Disclaimer of Warranties

PairIQ is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties that the App will meet your specific requirements or health goals

Nutritional absorption values and scores provided by PairIQ are estimates based on population-level research and may not reflect your individual response.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10 Limitation of Liability

To the fullest extent permitted by applicable law, PairIQ LLC and its owners, officers, employees, and affiliates shall not be liable for:

Any damages exceeding the greater of (a) the amount you paid to PairIQ for the App in the twelve months preceding the claim, or (b) twenty-five U.S. dollars ($25)

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11 Indemnification

You agree to indemnify, defend, and hold harmless PairIQ LLC and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another party.

12 Third-Party Services

PairIQ uses the following third-party services:

Apple App Store — app distribution and payment processing. apple.com/legal

Open Food Facts — packaged product data, used under the Open Database License. Nutrient composition data comes from USDA FoodData Central.

PairIQ is not responsible for the practices, content, or availability of any third-party services. Your use of these services is subject to their respective terms.

13 Termination

You may stop using the App at any time by deleting it from your device. Cancelling a subscription is handled through Apple as described in Section 7.

We may suspend or terminate your access to the App, in whole or in part, if you materially breach these Terms, if required by law, or if we discontinue the App. If we discontinue the App entirely, we will make reasonable efforts to provide advance notice through the App or our website.

Because your meal data is stored locally on your device, termination does not delete it — deleting the App does. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — survive.

14 Modifications to the App and Terms

We reserve the right to:

Material changes will be indicated by an updated "Last Updated" date, and where the change is significant we will provide notice in the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

15 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Informal resolution first. Before filing a claim, you agree to contact us at info@pairiqapp.com and attempt to resolve the dispute informally. If the dispute is not resolved within 30 days, either party may proceed as described below.

Arbitration. Any dispute not resolved informally shall be submitted to binding individual arbitration in the State of Florida under the rules of the American Arbitration Association. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Small claims exception. Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.

Class action waiver. You and PairIQ agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Your right to opt out. You may opt out of this arbitration agreement and class action waiver by emailing info@pairiqapp.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

EU and UK users. If you are located in the European Union or United Kingdom, nothing in this section deprives you of the protection of mandatory consumer law in your country of residence, and you may bring proceedings in the courts of that country.

16 General Provisions

Severability. If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets, on notice to you.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including network or hosting outages, natural disasters, or acts of government.

Entire agreement. These Terms, together with our Privacy Policy at pairiqapp.com/privacy, constitute the entire agreement between you and PairIQ LLC regarding your use of the App and supersede all prior agreements and understandings.
